Unix For Sale: $36M, Anyone?
Is SCO preparing for the conversion of its bankruptcy to Chapter 7?

SCO Group asked for approval from Judge Gross of the bankruptcy court last week to sell off Unix to the highest bidder, which curently would mean York Capital Management, a financial firm. If SCO does receive $36 million, Novell and IBM (and perhaps others) will certainly be hoping that the money will in turn come to them.

York's offer is basically $10 million down and a $6 million revenue-sharing arrangement over three years. SCO would be paid $1 million in year one, $2 million in year two and $3 million in year three.

SCO had reportedly been talking to other interested parties but apparently none has yet trumped York's offer.

SCO filed a PROPOSED order on 10/23 but it has not been approved by the court. The court MAY approve it after the November 6 hearing.

No they didn't get approval SCO made a motion seeking it but other parties get a chance to object before the Judge signs off on it , if in fact he does.

That's a really interesting story since all that's happened so far is that SCO has asked the court for permission to sell its Unix assets. So far the judge hasn't said yea or nay. Do you guys just maske this stuff up?

You need to get your facts straight. SCO has only ASKED for permission from the bankruptcy court to sell. The judge has not signed the order and will not until all creditors have been notified and have had a chance to object to the sale.

As Groklaw has reported, so far, this is only a proposal by the SCO Group. The judge might or might not approve this proposal. Approval wouldn't be before the hearing on Nov. 6th in any case.

Your facts are incorrect.

There will be a hearing scheduled for November 6 to get approval to sell off Unix.
